Terms of use of JSC Studio Web Portal

1. Welcome to JSC Studio!
Thanks for using our products and services (“Services”). The Services are provided by JSC Studio (“JSC Studio”), located at 1-F Lintang Pantai Jerjak 6, 11900, Bayan Lepas, Penang, Malaysia. By using our Services, you are agreeing to these terms. Please read them carefully. Our Services are very diverse, so sometimes additional terms or product requirements (including age requirements) may apply. Additional terms will be available with the relevant Services, and those additional terms become part of your agreement with us if you use those Services.

JSC Studio with Company Registration Number 002367326-V (Operating identity “JSC Studio”) owns and provides services in specialized in providing Publishing of Newspaper, Journals, Magazines, & Periodical in Print or Electronic, Reproduction of Works of Art, Advertising Material & Other Printed Matter N.E.C., Providing infrastructure for Hosting, Data Processing and Related Activities, Publishing of Catalogues, Photos, Postcards, Greeting Cards, Forms, Posters, Services of Graphic Designers, Banner, Business Card, Flyer, Poster and Etc.

Planning, Preparing, Organising, and Managing Events, All Kind of Events, Motion Picture, Video and Television Programme Production Activities, Photographic Activities, Corporate, Events, Wedding, Models and Etc, Web Portals, Developed and Design Website that required, Sound Recording and Music Publishing Services in the Country of Malaysia which owns and operates the JSC Studio Website (“”), (collectively, the “Sites” or “We”). 

2. Changes to These Terms & Conditions
JSC Studio reserves the right, at its sole discretion, to change, modify, update, add, or remove portions of the this Agreement from time to time without notice. Any changes in our terms of use will be incorporated into a revised Agreement that we will post on the Sites. JSC Studio has the right to change or modify, upgrade, add to, or discontinue the Services or any portion or feature thereof at any time without notice. JSC Studio also reserves the right to assign any rights, licenses, or obligations arising out of or relating to these Terms of Use without restriction and on its own discretion.

All visitors have the obligation to review changes to this Agreement, including any changes to our Privacy Policy. Unless otherwise specified, such changes shall be effective when they are posted. Your access or use of our Sites constitutes your agreement to be bound by this Agreement, including any changes that exist when you re-access our Sites. If you do not agree with The Term Of This Agreement, Or Any Posted Guidelines Or Rules, Then Do Not Use Out Sites. The Customers are kindly invited to check these Terms of Use, available on the JSC Studio website, subject to changes from time to time. 

3. Your Registration and Submission of Personal Information to the Sites
Customers must register and create a profile on JSC Studio | The Online Store,  to access and use the Services. If Customers are registering on behalf of a company and/or organisation by registering, they confirm and agree that they have the requisite authority to register on behalf of such company and/or organisation. By using the same applies if the Customers act on behalf of other person(s).  The email address provided during the registration will be the login for the JSC Studio | The Online Store Account. Each account must have a unique email address and Customers agree to not create more than one account under the same email address.

By accessing and using the Services, the Customers (hereinafter as “Customers”) agree to accept the terms and conditions set forth below (the “Terms of Use”) on behalf of themselves and / or their companies, or represented person/company, and that this relationship(s) are and will be bound by the Terms of Use. If the Customers do not agree to be subject to these Terms of Use, they are requested to immediately stop using the Services. By continuing to use the Services, the Customers automatically agree to be bound by these Terms of Use.  To participate and/or register as the Customers on our Sites, we may request you to submit certain personal identifiable information about yourself, including your name and personal contact information (“Personal Information”).

Customers warrant that any information provided during registration or at any time thereafter is true. We may also gather certain types of non-personal information about your visit to protect the security of our members or our Sites or to make our program content more enjoyable for all our customers. All information gathered from visitors by the Sites will be governed by our Privacy Policy, which is incorporated in this Terms of Use Agreement by reference. If there is a conflict between the terms of this Agreement and our Privacy Policy, the terms of thePrivacy Policy will prevail. Please carefully review our Privacy Policy to understand our collection, use and disclosure practices. You are responsible for providing accurate, timely and complete information to us and our operational providers (Third parties that perform services on our behalf), agents and affiliates in connection with your participation and/or use of our Sites.

 By registering, Customers confirm that they are a valid business desiring to use the Services with aim to find, obtain/provide sponsoring, also find events, and advertise the business and/or to conclude the deals for services. Any information provided about Customers’ business (information about event, exhibition or other) or contact information (such as email addresses, banking account number and phone numbers and etc.) must be valid and accurate contact information. Your Registration in the Sites’ activities will be canceled without notice if, at any time, we discover that you provide false information or violate any term of this Agreement or our Privacy Policy.

 The Sites, their operational and promotional providers, program producers and promoters, parents, partners, affiliates, subsidiaries and sponsors are not liable or responsible for any claims relating to any inaccurate, untimely, false or incomplete information provided to us or from a visitor’s failure to fully comply with any provision of this Agreement. If necessary, and in accordance with applicable law, the Sites will cooperate with local, state and/or federal authorities to protect the Sites, visitors, customers, partners, affiliates, subsidiaries and operational providers or to prevent unauthorized use of the Sites. Including contact or identification details in comments such as phone numbers, postal or email addresses is not allowed on most services. Please do not reveal any personal information about yourself or others as it might inadvertently put you or someone else at risk.

4. Copyrights, All Right Reserved and Trademarks
All files, content, graphics, photos, videos, soundbites, records, html codes, php codes, look and feel, documents, blueprints, specifications, information, letters, notes, media lists, original artwork/creative, script, storyboard, notebooks, written, printed, graphic or electronically recorded, material, ideas, creations, developments, innovations, improvements, trade secrets, concepts, inventions, processes, information, records, business plans, business strategies, customer lists, operating procedures, design, formulas, know-how and processes, computer programs, 
computer software (in object code or source code form), technical data, a product plans, products, database information services, products, database information services, and inventories, discoveries, technology, designs, marketing, financial information, and improvements of any kind, and specifications owned and similar items relating to the duties and/or the business of the Company on this site are protected by Malaysian Copyright Law and international Treaties and may not be copied or re-used without the express permission of JSC Studio (hereinafter referred to as “The Company”), which reserve all rights.

You may not copy or adapt the HTML code that the Company creates to display pages. It also is covered by The Company’s copyright. The “look” and “feel” of JSC Studio and its subsites also are trademarks of The Company. This includes JSC Studio Website colour scheme, button shapes, layout, and all other graphical elements. Third party material contained in JSC Studio Website is protected by copyright and shall not be published, broadcast, rewritten for broadcast or publication or redistributed directly or indirectly in any medium.  Re-use of any of such content online for any purpose is strictly prohibited. Permission to use The Company’s proprietary content may be granted on a case-by-case basis.Neither this material nor any portion thereof may be stored in a computer except for personal and non-commercial use. 

The gency/agencies will not be held liable for any delays, inaccuracies, errors or omissions therefrom or in the transmission or delivery of all or any part thereof or for any damages arising from any of the foregoing. Among the trademarks and service marks owned by The Company are JSC Studio Website, JSC Studio | The Online Store, JSC Studio Demo Website, Pocket News Web Portal, Pocket News | Images Store and the respective documents, files, design, logos of all the sites. All other trademarks and trade names are the property of their respective owners. Please direct your enquiries to [email protected].

The materials from this website are available for informational and non-commercial offline use only, provided that: the content and/or graphics are not modified, amended or altered in any way whatsoever; all copyright and other notices on any copy are retained; and permission in writing has been granted by The Company. You may not display the content or material contained in in a website whether for commercial or personal purposes without the express written permission of  The Company first had and obtained.

5. Fees/Pricing: Payment Terms
The packages fees/pricing for using and/or purchasing on the JSC Studio | The Online Store are indicated on the JSC Studio Website. If Customers choose the paid package(s) or additional options as set forth on the on JSC Studio Website or in JSC Studio | The Online Store or in any other JSC Studio agreement(s) or in Terms of Use, they agree to pay all charges for the Services as indicated on the website, in the respective agreement, or in Terms of Use. The Customers agree that the address, the email address, fax they provide in their account settings are valid business addresses and that JSC Studio may invoice these Customers at such addresses/numbers or through other electronic or facsimile communications.

Any charges invoiced by JSC Studio are exclusive of all taxes, levies, or duties imposed by the taxing authorities, and Customers shall be responsible for payment of all such taxes, levies, or duties. All fees paid to JSC Studio by pursuant to these Terms of Use are nonrefundable. JSC Studio reserves the right, at any time and at its discretion, to change any fees and any other pricing terms for the Services or additional features on JSC Studio. Any changes shall be posted on the JSC Studio Website or communicated to the Customers per email/fax/mail or other means and will be effective immediately after a prior notification of 1 week to the Customers. 

6. Payment Authorization: Invoicing

JSC Studio will invoice the Customers on a single, or monthly, or yearly (depending on the chosen services packages) basis, in advance are 50% and full amounts after completion and due to JSC Studio. Each invoice shall set forth the fees to be incurred in the forthcoming month (hereinafter the “JSC Studio Invoice”). JSC Studio agrees to post each JSC Studio Invoice on the Customers’ online account within one week of the first day of the applicable calendar month (hereinafter the “Invoice Posting Date”) or in case of the single payment at latest one week after the paid Services have occurred/have been concluded.

By providing a credit card or any other payment information either during registration or at any time thereafter, each Organizer or Sponsor warrants that such credit card or payment gateway is correct and valid, and authorize JSC Studio to charge such credit card or payment gateway for amounts due under the JSC Studio Invoices pursuant to the payment schedule set forth in present section below.

Payment Schedule for each JSC Studio Invoice, JSC Studio will charge to the credit card or payment gateway, listed in the Customers’ account, all undisputed amounts of such JSC Studio Invoice at the day of the Invoice Posting Date. Customers are responsible for logging in and timely reviewing any JSC Studio Invoice. All amounts on JSC Studio Invoice shall be deemed to be undisputed unless you submit a disputed charge claim to JSC Studio pursuant to Section 9, below. Once an amount has been charged to a Customers’ credit card or payment gateway, it is nonrefundable.

7. Disputed Charges 
If the Customers wish to dispute any fees or charges invoiced by JSC Studio, the Customers agree to submit the disputed fee or charge to JSC Studio no later than five (5) business days after the JSC Studio Invoice containing the disputed fee or charge is sent for payment. The Customers are responsible for logging in and timely reviewing any JSC Studio Invoice. Each customer may submit a disputed fee or charge by contacting JSC Studio by registered mail. 

8. Electronic Communication
JSC Studio reserves the right to contact the Customers from time to time for feedback about the Services, Special Announcements and for Service and Support related issues through e-mail, facsimiles, text or voice messages, or notices posted on JSC Studio Website. Notices will be deemed effective at the time they are sent by JSC Studio or as of date they are posted, regardless of whether the Customers actually read any such notices.

Customers may opt-out of receiving notifications through the Services by logging into the account and changing the notification settings; opting-out of such notifications, however, will limit the effectiveness of the Services. Customers may not opt-out of receiving notifications relating to support of the Services or other notices as required by law. Customers consent that any emails, surveys, other information or feedback provided to JSC Studio through the The Online Store or via any other medium, except for Personally Identifiable Information can be used by JSC Studio in any manner, including but not limited to testimonials, reviews and ratings on JSC Studio or third party websites.

9. Risk Breaching Copyright Law
Copyright law exists to stop someone from plagiarising another’s work. It applies to the Internet in the same way as it does to Website, Online Store and Services. Breaking copyright law can result in being taken to court. Please do not post large chunks of text copied from other sources, as this may be an infringement of copyright. Short quotes to illustrate a point may be permissible, although this is at our discretion. 

If you wish to refer to external sources of information, it’s better to include a link to an appropriate external website. In addition to this, postings with heavy text speak or unintelligible language such as codes, are also not allowed as this may disrupt the natural flow of conversation. In addition, we may remove posts which we consider could endanger other users – which shall include but not limited to, offering medical and health advice, or encouraging drug or alcohol abuse or self-harm.

10. Contain Spam and Unsuitable URLs
Spamming or flooding is not allowed on JSC Studio Websites, The Online Store and Demo Website. Spamming means submitting the same or very similar contribution many times across blogs or entries. Flooding comprises a resubmission of your contribution to the same site multiple times. Please do not use a signature beneath your comment to promote websites, services, products, or campaigns. This will cause your posts to be removed as spam.

For example you should not link to Unlawful, unsuitable or sexually explicit content. Websites that require payment to access. Foreign language content. Websites that initiate a file download or require additional software in order to view them. This includes .pdf and .mp3 files. Websites that advertise or promote products In some cases the moderator will edit out the link/s leaving the rest of the comment visible on the board.

If so the link will be replaced by [Unsuitable/ broken URL removed by moderator] The Company welcomes feedback, both positive and negative, about our programmes and services but please make sure your comments are in line with the above House Rules. Repeatedly posting personal or offensive comments about individual members of the public or people who work for The Company and its group of companies may be considered harassment. We reserve the right to remove such messages and take action against those responsible.

11. Use of the Services
Customers may not use the Services in any manner that is illegal or harmful to the Services or JSC Studio. Among other restrictions, Customers agree not to:

  • Transmit information that infringes the rights of others or is abusive, pornographic, violent, racist, discriminatory, offensive, vulgar, obscene, defamatory, invasive of personal privacy, harassing, threatening, or otherwise objectionable;
  • Translate, reverse-engineer, decompile, disassemble, modify, or make derivative works from the Services or Services software (accept as applicable law expressly permits);
  • Use automated means, including spiders, robots, crawlers, data mining tools, or the like to download data from the Services, unless expressly permitted by JSC Studio.
  • Interfere with, or attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from any JSC Studio Servers;
  • Use the Services in a way that disables the Services or prevents or inhibits anyone from using the Services; or
  • Take any action that imposes an unreasonable or large load on JSC Studios infrastructure;
  • Remove, obscure or alter any notices or indications of rights in or to the JSC Studio;
  • Impersonate any person or entity in order to use, or through use of, the Services.
  • Upload invalid data, viruses, worms, or other harmful software to the Services;
  • Use the Services through unauthorised interfaces or protocols;

 12. Disclaimers and Warnings
A. Disclaimer Option.The Company seeks to ensure that information contained in these pages is accurate. However, The Company makes no representations as to accuracy, correctness, completeness, suitability, validity of any information on these pages and will not be liable for any errors, omissions, delay in the information contained in this pages or any other information accessed via this site, including without limitation, any information reached via links on this site to external sites, or any losses, injuries or damages arising from its display or use. All users are strongly encouraged to seek professional advice before relying on any information provided herein.

B. Warning Option. To avoid disappointment, we encourage you to consult our Terms and Conditions and Privacy Policy before commenting. Please be aware that your comment is subject to these rules as well as our Terms & Conditions and may be removed without prior notice should it violate either of the aforementioned.

13. Consent
The Company seeks to use your personal information only for the purposes of legitimate interests and, with your consent. For subscribers, it is a condition of acceptance to the collection, collation, use and/or disclosure of all the personal information by The Company for the purposes of subscribing to the package. By subscribing, you signify your agreement. We only keep Personal Information for as long as is necessary to satisfy the specified Purposes, for which it was collected. We retain Personal Information in accordance with our own guidelines, procedures and principles and in line with applicable legislation. 

We may disclose your Personal Information to other subsidiaries within The Company’s group or to a Vendor (often referred to as the data processor). “Vendor” means in relation to Personal Information any person or entity (other than an employee of The Company) who processes the Personal Information on behalf of The Company. “Processing”, in relation to Personal Information means for example obtaining, recording, holding or using the Personal Information in carrying out any operation or set of operations on the Personal Information including organisation, compilation, retrieval disclosure of the Personal Information for verification Purposes.

These subsidiaries will treat your Personal Information as confidential, in accordance with all applicable Data Protection legislation and will process such Personal Information only for the Purposes and within the terms set out herein. We may disclose your Personal Information if we are required to do so by law or requirement of a competent authority. In addition to the above, we may from time to time work on specific initiatives with carefully selected third party companies/organisations (outside of The Company) to share opportunities with you. If we do this, we will inform you at the time of such initiatives that, if you decide to submit any Personal Information, it will be shared with those selected companies or organisations and we will only do so with your prior consent.

In the event of such termination, Customers agree to remove any and all Content provided by JSC Studio from all of their hard drives and any other storage media and to destroy all copies of the Content in their possession.  At any time, you can withdraw your consent to our services, use or disclosure (generally Processing) of your Personal Information by writing to us in the prescribed manner (whether by email, letter or fax), as specified in our communications to you, or in relevant forms that you might have signed (e.g. for our customer loyalty scheme).

If you have any concerns whatsoever, with regard to the unsubscribe functionality that we make available to you, pursuant to this section, please contact us at the address or medium shown in section 10 of this Terms and Conditions. If you have previously opted into receiving commercial communications from us, while also becoming a member of our loyalty scheme, should your registration to such scheme comes to an end for whatever reason, we will not take this to imply an automatic request to unsubscribe, and we will assume that we have your continued consent, unless you specifically unsubscribe.
